The FDA justified its decision to resolve the shortage by saying that the maker of tirzepatide drugs, Eli Lilly, had assured the agency that its product availability and manufacturing capacity can meet the present and projected national demand. However, the FDA cautioned that there still could be intermittent localized supply disruptions. In their lawsuit last week, compounders countered that the shortage remained and that the agency had simply taken Lillys word, which is self-interested in monopolizing the market. In a court filing Friday, the FDA appeared to back down, requesting that the lawsuit be placed on hold, essentially, so that the agency had the opportunity to reevaluate the decision at issue in this case. With its request, the FDA cited previous court rulings that set precedent for the agency to get a chance to reverse course
